Ebuyer - shocking service

I ordered a tv for my little sister before Xmas from these clowns, to be delivered on 23rd December.

When i got home, I found a card put through my door saying that it had been left around the back. When I went around the back, no TV.

Went to my account online and found that it had been signed for!!! but not by me, by someone else from in the block of flats that overlooks my house, 2 doors down.

Spoke to the guy in the flat, he said he was asked to sign for it, but said he didnt have it, and the slip seems to clarify this by saying it was left at the back. I spoke to ebuyer, they claim that he signed for it, and it was left with him. After much toing and froing, back and forth, they are saying that its in their T&Cs that it can be signed for by a neighbour. I asked them where this was, and made them back down by agreeing that it wasnt in there.

Now they feel that I must raise a police complaint and go through my insurers for recompense. I am fighting back on this with them, that its not my problem, I did not agree to them letting a neighbour sign for it, and put it somewhere else.

I have had to splash out again for a very late present for my Sister so she didnt go without on Xmas day, and now i am furiously trying to sort this.

What are my rights, and is the best way to resolve this to contact my credit card company and let them do the bizzo?

I`d go through the CC company as they have far more clout with this sort of thing.

Credit Card is the way togo... i hope Ebuyer go bust in the credit crunch, they are by far and away the worst company i have dealt with, twice i have ordered from them, twice they have delivered faulty goods... and i have had to pay to return them and then fight for a refund!
and twice i have ordered items both times showing in stock, only to find they are out of stock by email, once after confirming they had packed the item ready for shipping.... utter wastes of space and time!

I have actually been trying to deal with them in a reasonable manner.

I have provided them with a copy of a delivery note that says it was left at my back door, but they are arguing back with the claim that as it was signed for by a neighbour then it is a police matter not theirs!!

Marksparks999 - what is the official line on this?

The information given is conflicting, since Parcelforce have claimed since day 1 that it was left with a neighbour, now they are going back on it saying that as there is proof it was signed for then nitto.

I have started chargeback proceedings, but am concerned now that I wont get my money back!

You should get your money back, especially from the CC company. Have you called eBuyer and tried to talking to different people? You might get a different result that way. I can see where they are coming from, considering it was signed, but equally it`s a real f***er for you. If anything, they should send out a new TV and make a claim against Parcel Force or their insurance.

I ordered a TV before Xmas, in the evening, and it was delivered by the following morning. It had a damaged box (and thus I was worried about the TV) so I called them and they sent out a replacement a day later. So at least someone here got some good service! :)

So it was deliverd on this day and nobody was at home even though you knew it was going to be deliverd that day. :/

I had to go out, I was Xmas shopping and was popping back periodically. I assumed that I would be able to collect it from the depot, as its only a few miles from my house.

It was a late deal that I took because the price was better than anywhere else.

Ben - I have spoken to numerous people, the last lot of communication has been done via an imbecile on enotes.

I have PM`d Marksparks to see what he has to say about it. I personally dont feel I should be claiming on my insurance over this since I have not signed for it. They think I should because a neighbour signed for it.

Matt - you don`t have to justify why you weren`t there mate, ignore the troll comment.

I think the courier company are totally at fault for not leaving it with the person who signed for it. That`s completely unacceptable in my opinion.

Unfortunately I can`t offer any advice on the matter, but wish you good luck with sorting it out.

The courier is definately to blame IMO but i gotta ask why in his right mind would your neighbour sign for a parcel then let the delivery man walk away with it?, madness!

Edit - Been having a read of ebuyers Delivery t&cs and couldn`t see any mention of `neighbours signing for packages`. I did see this though:

Doesn`t that mean that after dispatch it can only be delivered to the shipping address unless you pay a tenner? :/

That`s right, it is.

But, you don`t have a contract with the courier; you have a contract with ebuyer which has a contract with the courier.

Your complaint is against ebuyer which can proceed against the courier if it wants to.

Tell ebuyer you will issue a small claim if you have to.

It`s not a matter for your insurer `cos it never came into your possession.

The goods aren`t faulty, well I expect not, so I don`t see the credit card company will assist but you could try.
