Page 1 of Help, Changed mind about rented flat, can i cancel my deposit?

Please help, in need of advise,
Was planning to move in with my partner, we viewed a property last Wednesday. The next day I handed in a covering letter and partial £200 deposit (cheque) to hold the property / take it off the website etc.

Since then we went into the agency on Saturday to collect the forms, a lady told me that they will expect the rest of the deposit in 7 days, basically next Thursday another £425, totaling £625.
Now our circumstanced have changed and we now don't want to rent.
We have not signed anything yet, but I did notice on one of the agency's forms, the "declaration" it states that if we pull out, they keep the partial deposit for the landlord's expenses. But this is a form that needs signed by both of us, and again we have not signed anything.

So basically I want to know, will I be able to get my cheque back? Will they charge me if I cancel the cheque? And if so will I get bad credit history because I cancelled the cheque? (Never cancelled one before :P)

I`d cancel your cheque bloody quick! And then don`t answer yer phone for a while ;)

Ditto. if you haven`t physically signed a contract you`re not legally bound to anything. However, bite the bullet, call and apologise for `mucking them around`. Or you may just find yourself on some `lists`.

Yes i know i have totally messed up, it is all my fault, i`m just trying to solve it, and not loose money in the process.
It was not my intention to waste time / its just i can not do it now, if i could i would, and i can only but apologise for wasting there time.

My bank once told me they dont cancel cheques under those circumstances. If they are lost they will, but if I have written one for payment for something then they wont cancel it.

The decision to rent a flat is a pretty major one, what on earth could have changed in 3 days to change yout mind?

And also, how would you feel if it was the other way round? A deposit is exactly that....security for you in that the flat was off the market, Security for the landlord that they have a tenant.

If you were the landlord you would be pretty annoyed I am sure, the deposit is compensation for you dropping out after they have taken the flat off the market - I think it`s your fault and you should lose the money.

Competely agree with retrogeezer. That`s the point of a deposit. While it`s been off the market, no one else has been able to get at it and the landlord is essentially losing money. Take it on the chin as a lesson learnt.

well, check my account this morning, and the money has been taken out, so the decision has been made for me. thanks for all the advice.
