Cat D crash - Accepting a price from the insurance company

r8sso (Elite) posted this on Tuesday, 1st April 2008, 16:59

I bought a car mid December and at the end of February it was in a crash which has since resulted in it being wrote off! >:( The other driver has admitted full responsibility for the accident, which is good, but I`m just wondering how much money I could get when it comes to settling.

I`ve been offered the value I paid in December for it but I`ll still be out of pocket as I`ve paid £175 for a years tracker subscription, £420 for a car service the week before the crash and also fees for transferring the reg - I`d also just put £60 of petrol in the car 2 mins before the crash!

Do you think I have an argument for these additional costs to be paid or should I be happy with getting the price I paid in December?

Thanks in advance.

Ross

When my better half had a crash.. many years ago it has to be said....

We challenged the amount we were offered from the insurance company... proved they were wrong and got more money... mind you if they have offered the amount you paid for it in Dec that woudl seem fair.....

Also we had legal cover on the insurance policy... only a few quid on the total premium... but that`s what we used to put forward all the extra claims... we even got £100 for having to use the bus to get to work!!...

Check with your insurance.... you may be able to do the same....

We live in a sue everyone for everything culture... you might as well try!!!

I was crashed into about 3 years ago.
At the time I too had just literally filled up with petrol the road before!

But as he was at fault I was able to claim everything on top of car value.
The next week they paid car value but it took almost a year to get everything else.

Petrol, car hire etc

Also put claim in for my neck too ;)

not the Porsche

Yep, 3 months of driving like Miss Daisy in the winter/wet only to have some old guy drive into the side of me! :( I might upload some pics if I get a minute. Looks like a tin opener has been taken down the side of the car.

My old Nissan Bluebird was lifted in 2001, the first offer by the insurance company was £600, I rejected it.... 5 days later they offered £900 :D

The old fella said, always reject the first offer. He was right!

pah, that`ll polish out, T-cut and some elbow grease goes a long way :D

Ive always been told never to accept the first offer (not that Ive had loads of crashes ..I used to work at a garage) I suppose if youve been offered the price you paid thats not too bad, do a bit of scouting about and see what the current price is, you might find that your actually up on the deal taking into consideration any depreciation, if the car is still worth about what you paid, Id argue the case of the `extras` you mentioned

If the car is under a year old, which yours is, you are really only entilted to the money you paid for the car, though most companies do pay out for a replacement car like for like, if it has gone up in price, since you bought it.

Any extra cost since you bought it, should just be an acceptable loss. Thinks like road tax, fuel, private number plate transfer, etc.

Same goes if you have fitted expensive aftermarket goodies, (unless declared, and premium changed to suit), like sunroofs, alloys, etc.

I think you have done very well, if you can take the money and go out and buy a replacement new car, similar or identical to your last one, with little loss.

Just think how little they give you due to devaluation, if the car was just over the one year old limit.

It is a disgrace that people think they are entitled to this money, and I despise the compensation culture that this country has developed. >:( >:(
