What are my rights? I am REALLY p***ed off!

Hello consumer law experts,

In October my DVD started having a mind of it`s own with regard to discs so I took it back to Comet who sent it away for repair. 2 weeks later, it`s mended and they send it back to the store to collect.

In December the subwoofer channel went very strange, I booked a visit from an engineer in early Jan and he came out and said "Yes, that`s not good." He took it to the workshop to get mended. A month later (today) they finally deliver it back to me, with the subwoofer channel mended. Great!

But blow me, the center channel is now just as distorted as the subwoofer channel was, and I am not happy.

I will be phoning them tomorrow and I want to know, after they have had itfor a month, what are my rights? Can I demand a new unit? A refund?

The question isn`t as simple as that. The Sale and Supply of Goods to Consumers Regulations 2002 covers this and you really need to read it (sorry) to find the bit which applies to your problems.

It`s not as arduous as it looks. It says that if the goods are duff (section 48A) then there are certain remedies - these are outlined in paragraphs 48 B C and D. 48 E governs what happens if it goes to court.

It is all open to interpretation, but I`d day that there is a major flaw in the product - something like a major power supply problem might cause faulty curcuitry like this. In such a case I would inform the retailer that under section 48B paragraph 1 B you require them to replace the goods. You can justify replacement and not repair considering the number of repairs carried out already. Do note 48B paragraph 3 though for exclusions the retailer may argue.

9/10 though they will run screaming if they think you know what you are on about and swap out a new one. Less hassle and everyone`s happy.

hi, you got it from Comet right?
well take them up on there "No Lemon" 3 times repair.
ask instore about it.
you should get a new Dvd player.

If you go in looking scary enough you will get what you want.

My dad returned a TV to them 18 months after buying it. It was under warranty, but the warranty only allowed repair. You have to act polite but precise. Hard to describe it.

I`m not totally sure with regard to your rights - but if it blatantly doesn`t work then you at least have a right to have it fixed properly.

There`s a common misunderstanding here about warranties/guarantees. Note that they all say they are provided in addition to your statutory rights?

That`s because goods are automatically covered against defects for SIX years from date of purchase. Exceptions are faults (or the cause of faults) which were not present at time of sale (but they have to prove that - which is impossible), goods which obviously had problems when purchased (ie a washing machine display model which had a big dent in the front) and sale items which are simply sold as seen.

That means that ALL extended warranties are a waste of money (note that they end after six years max too? It`s for the same reason - the insurance company can`t claim from the manufacturer anymore). They give you nothing you weren`t entitled to already.

Any doubters/interested I can post the Act which this info comes from.

And give `em hell when you call tomorrow!

I`m looking forward to giving them hell. I can`t believe that they didn`t test it before they sent it back to me.

I will certainly be telling them that I want a new unit or a refund.

I experienced similar hassle with Compaq fairly recently, as my previous laptop was constantly faulty and even after sending it back to them three times the fault prevailed as well as new ones cropping up. Quality control? Meh.

Curry`s Policy is to right off the unit and give you a replacement or credit towards a new unit but only if you`ve had to bring it in for repair for a fourth time within 12 months, my kids had a really great spec LG mini Hi-Fi that eventually got replaced for new after 9 months for a new replacement with a new 12 month gaurantee , damn thing continuosly jumped once it had warmed up.....Good Luck "Go Get `Em"!
