Blackstar LOTR offer NOT being honoured

Brian Elliott (Reviewer) posted this on Tuesday, 11th November 2003, 18:14

Hi guys,

I just got an e-mail to say that this deal will not be honoured, and that the company will not charge my credit card. As suspected, the £3.99 deal only comes into play if you buy "Two Towers" as well.

Oh well, it was worth the try!

PS. I realise this isn`t a bargain as such, more relating to one, so Mods, change thy forum if thou wish!

Me too, gutted here it is for those who didn`t get the chance to take up the offer:

Dear ...

You have placed an order for The Lord Of The Rings: The Fellowship Of The
Ring which was priced at 3.99 GBP. However, this item was only available
at this price if purchased in conjunction with The Lord Of The Rings: The
Two Towers at a combined price of 19.99 GBP. Unfortunately our suppliers
will only release supplies of this item at 3.99 GBP if we sell both of
these DVDs together for 19.99 GBP.

We will therefore cancel your order for The Fellowship of The Ring as a
single item and your credit card will not be charged.

etc
etc...

Yeah - shame but not a total surprise. They have reactivated the voucher though so I might just take them up on the offer of £7.99 minus the £3 voucher. Unless anyone has seen this for less than £4.99 delivered !!! Still seems like a bargain to me.

You can`t beat a good bargain !!!

If a shop offers a product at a price, whether mistakenly or not, then it has to honour the price by law.

As far as I am aware, retail law is the same in this regard for websites. I have e-mailed Black Star back and said that I do no accept their retraction as I do not think it is legal.

I shall keep you informed of any reply I receive.

My knowledge of commerce laws is scant at best, so I recommend you let clayts explain it here: http://www.dvd.reviewer.co.uk/forums/thread.asp?Forum=223&Thread=231821&Type=1

Before we go down the same path AGAIN - see Clayts response in this thread - if they had charged peoples cards legally there is a contract for the supply of goods.

Must agree with Clayts - fine if company is able to stand the loss ( at a guess 2000 @ £7 ) - but would rather they were able to keep Joe Bloggs in a job.

Edit - whoops seems like we`re all responding on the same lines at the same time.

Yes, never really expected them to agree to this, I also don`t blame them either. Good to see they have the decency to re-activate the voucher code, and like `ran dan` I may yet use it. Was worth a try but not worth hassling a good company to honour it. Roger.
