fao - Clayts, Westy and anyone else interested...

Thanks for the advice earlier this week. All taken on board. however, in fairness to Avon Video, they took the set, had it for two days, called me in and set up a number of different signals ranging from DVD, SKy, RF and even the test patterns that they use. So, I now have the set back and from a SKY TV and PS2 point of view, things are well.

However, I think I may have established that my Toshiba 210e is faulty. The bending, warping and kinking I referred to earlier this week clearly happens when you play a 16.9 image, especially if there are light backgrounds with a lot of vertical staight edges.

I went back to John Lewis last night and they said that they use Bristol Sony Service centre to asceratin if any goods are faulty. The `engineer` is due out next saturday. I then enquired what the replacement procedure would be, and they saad that if the DVD is found to be faulty they will send it away for repair.mm not happy.

Right, considering that I have only had the player since the first week of September am I not obliged to seek either a full refund or an exchange machine irrespective of the offer of repair. Essentially, I do not want to own a reconditioned machine even if it has been repaired. Its not acceptable really is it. So, I intend to go back to Lewis`s once the fault has been confirmed and `demand` a replacement/refund.

Can you point me in the direction of legal jargon/sites that may offer advice as I intend to set up camp and distract other shoppers until my machine is sorted. This is only because of how much s*** I took over the TVs. I am not going to let it happen again !!!!

Can I do that, is it legal ? or could I face breach of the peace and all that.

As I said, replacement of a 2 - 1/2 - 3 month old machine is hardly unreasonable is it.

Thanks guys.

In my experience, sod the legalities. A strong, vocal, manner has always worked for me in the past.Seriously Pete !
I`ve always found that taking a ` don`t mess with me ` attitude has always worked and I`ve successfully exchanged TV`s, videos, mobile phones, fridges and a washing machine. The washing machine was a laugh. It started smoking badly and it turned out that I`d left some plastic wrapping underneath the machine when unpacking it. I took the aggressive and asked them how the hell I was supposed to ensure that all the wrapping was out from under the machine when it weighs a ton and their boys dumped it in the middle of my kitchen for me to unwrap !
Scottish Power agreed and exchanged it no probs ! Just an example of how an ` aggressive `, but not rude, manner can get you success. If I were you I`d be on the phone to John Lewis saying that you`ve thought about it and you`re not accepting a repair of any kind on a 2 month old machine and you`re coming back with it. No arguments, no excuses, no buts.

As far as i am aware you are entitled to a new player or maybe even a full refund subject to it being found faulty. You do not have to agree to have a repair. You may even be entitled to some kind of compensation from the tests you had to pay for on your tv which were a result of the faulty goods which were supplied by that store.
I agree with bowf, take a slightly agressive (but not rude or offensive) approach , make it clear that you are not interested in a repair and let them know that you are aware of your legal rights. And allways make sure you deal with the store manager if possible. Don`t waste your time with sales staff who will only have to go and consult the manager anyway.
hope this helps.
