Just got parking ticket - I don`t think it justified - What do you think?

Here`s where I parked



- Everything to the left of the green is Council Highway
- Everything to the right of the green is private land
- No one knows who owns the land in green but the traffic warden insisted it belonged to the council.



Traffic warden said I was causing an obstruction to vehicles wanting to get on and off the private land even though they could get past as one did while she was writing the ticket.


Should I pay or appeal?

DONT PAY UP.

Sorry for shouting. Now that`s out of the way, check your ticket. Does it have a two dates or just one? i.e. does it have date of issue and date of contravention or just date of issue.

If it has only one date then the council dont have a leg to stand on. Justice Jackson recently ruled in the High Court - where precedents are binding law, that all tickets without two dates as stated above were a nullity and as such the council would NOT be able to enforce them.

Besides which there might be a 100 other things which could be wrong with the ticket.

So contrary to our resident man in blue, DONT PAY UP.

Speed cameras alongwith harebrained parking schemes are just government methods of making money. A recent report actually acknowledged that the KSIs (statistics regarding collisions) have not changed since the massive jump in the number of speed cameras, and the 11% drop in highway patrols actually led to a sharp rise in the number of casualties in hospitals.

For further advice, visit www.pepipoo.com and explain your situation to them. They will ask you to post the ticket so that they can comment.

As you`re in the know, is `obstructing` the same as `blocking`.

A car did get past as she was writing the ticket and the other car in the picture only had to do a `U-turn` to get past.

i have to say its a harsh one without knowing all the facts...

from the photo it looks like the clio cannot get out... also how long were yo there just 2 or 3 minutes or were you taking the proverbial and parked there for hours? you say you dont know who owns the land... well the clio owner must do? had they complained about being `blocked in` if so thats why you were stuck on for `obstruction`... if not then i fail to see who you were obstructing in which case i would fight it...

you already said somebody drove past which indicates that no obstruction of a highway has taken place!

I was there only 10 minutes before I got the ticket, but I intended to stay all day as that entire area is private parking for all the shops, of which one is where I work.

Funny enough, the Clio shouldn`t have been there as it didn`t belong to any employee from any of the shops and was parked where I usually park.

Only the land I coloured green is the section no one is sure who owns. The council don`t maintain it, they only maintain the road surface up to the green section. All enquiries to the council have drawn a blank. They wont say they don`t own it but, can`t tell us who does. The shops don`t maintain it because they don`t think it belongs to them.

Because no one knew who owned the piece of land, the traffic warden decided the council owned it and that any parking restrictions applied from the yellow line up to where the private land begins.

She had already booked me for obstruction when I went to my car but, when confronted, kept switching from that to parking on a yellow line.

I don`t think she was sure herself.
