A question about wages

OK

My son works in a store that had a major refit.

He usually works days but, was asked if during the refit he could work nights to allow contractors to work through the night.

He agreed.

His wage usually came out of store budget but, during the refit, it came from the refit project budget.

The money allowed for his wage out of the project budget was for 12 hours a day for 4 weeks. That's working 6pm - 6 am every day for 4 weeks.

So, he had to make himself available for that time slot for 4 weeks.

He was instructed by his manager that during the refit he must leave the building when the contractors leave. For security reasons one person is not allowed on premises on their own.

During the 4 weeks, the contractors finished at different times. Anything from 10pm to 5am in the morning, so my son had to leave at the same times.

However, the contractors got paid up to 6am as their money came out of project budget and they finished the work on time.

My son only got paid for the time he was there even though he made himself available for the full 12 hours, at much disruption to his family life I might add.

So, my question is, should he accept this or, take it further and try to get payment for the time he made himself available?

He was contracted for 12 hours.

If you have to leave the store\factory early due to circumstances beyond your control ie bosses close down the factory due to extreme weather conditions by the company, your entitled to be paid for the normal working day.

From the last time I worked nights, he should have been getting a unsocial hours bonus & a meal allowance as well.

Sounds like he was doing a 60 hour week for 4 weeks non stop. So there should be overtime in there as well.

I would take it further as that sounds exploitive to me.


I consider myself an optimist, albeit an optimist with cynical tendencies and a dark side that Lucifer himself would find a little creepy. (Perhaps you've noticed.) You don't normally associate cynicism with an upbeat pov. But I have exactly that combination and will defend it.

have to disagree... having worked in a previous life for several multi-national retailers, the only thing that will happen by kicking up will be, he will manage himself out of a job!
