Nicked for speeding....again....

Blue John (Elite) posted this on Friday, 30th December 2005, 12:27

I have no defence as far as I`m aware (although I have yet to see the picture) and will take the rap without a fuss, except.....

Just wondering if, because the bottom part of the following has not been signed I might just have a chance of getting off with this:

Ta - how would you go about it? Send them a letter with a copy of the form?

yes... send a letter stating that the form is incomplete, and a copy of the form...

you could also try looking at this website www.ukspeedtraps.co.uk there are some knowledgable people on there some traffic offciers who may be able to point you in a more accurate direction.

I wouldn`t query it
I would let it lie and see what happens
They have 14 days plus postage to notify you,but they have not signed and dated the part that specifies when it was sent to you,so how can they prove you got it within the required period ?

They can`t. 8)

" I didn`t receive an NIP,when did you send it "
" err..................."
" Tata then "

:D

Edit; Even if you don`t want to deny you got it,state you got it outwith the alloted period, say the middle of January.
The lack of postage date on the form means they have no means of denying your claim.

Cheers Bowfer

It is, if you look closely enough, dated at the top of the form, near to the case number.

That`s the date the form was printed, not the date it was posted to you.
Why bother with a seperate section for postal date if it`s not important ?

As far as I can see, they have no proof that the notice was issued to you AT ALL.
It`s not signed or dated to say so,so how the hell can they prove you got it ??
They can`t.

They merely have proof the form was printed, not issued.

Another thing I`ve just noticed. The bottom part states:

Quote:
FOR POLICE USE ONLY

I HEREBY CERTIFY that I this day served the within-named defendant with a document of which this is a true copy, by sending it to him/her in a prepaid envelope addressed as above, being his/her last known place of abode

Date.............Signed...........

It wasn`t sent in a prepaid envelope. It was sent in a window envelope with my name & address on the form showing through the window. It was franked, not prepaid.

Same thing
They just mean that the postman didn`t have to ask you for the postage.

Seriously,if it were me,I`d leave it until quite a few days after the allowed time period.
Then I`d phone them and say you just received an NIP for an offence that took place ages ago.
They have absolutely no way of proving when it was posted to you.
If they ask when the envelope is dated, say you`ve binned it.

If the date the form was raised is automatically the date it is issued, then they wouldn`t have the seperate box at the bottom specifically stating when it has been issued.
There is obviously the possibility for the date of printing and the date of issue to be different, hence the requirement for them to state them seperately.

Up to you,but I`d fight this one myself.
