Splash (and the Law?)

Ordered eternal darkness for Game Cube on Sunday for £3.99 from Splash . Today however they have informed me that the price was wrong due to a " software problem " and they wouldf be refunding my Card . As Splash always charge your Credit card before doing anything , and mine has been charge , have I got a solid case to get them to send the game ?

Cheers

I would say yes if Splash were in the UK, but is Jersey covered by the Sales of Goods Act ? I suspect not, somehow...

Taken from their terms and conditions;

I"SplashDVD.com does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services."

They say this is an error, so I`d say you wouldn`t have a solid case, but I`m not a lawyer.

That`s a real shame, because they would have been obliged to supply it at that price if they were based in the mainland :(
