Any solicitors in the house??

Blue John (Elite) posted this on Tuesday, 3rd May 2005, 11:40

As you may or may not know, I got done for speeding a few weeks ago (48mph in a 40 zone).

Showed the documents to police, sent my licence off & paid the fine. Got my licence back last week. However, it has the wrong offence code on it - SP50 (speeding on motorway) instead of SP30. Spoke to the points issuing bods who said that SP50 was the offence in their system.

It would therefore appear that the officer who issued the ticket filled it in wrong. Now that I`ve paid the fine, etc, do I have any right to appeal to get the points removed and my £60 back? How was I to know at the time that the offence code on the ticket (I think it said 1610, but don`t have it to hand) does not equate to speeding on a normal road?

Any advice greatly appreciated...

Cheers

Should the officer have written down where the offence accured as a matter of course? I would expect so. Try calling the police station and have them look at his paper work. the speeding people may well only have the code passed on to them?

If memory serves me correctly my copy of the ticket does indeed have the location of where the offence occurred - Glascote Road, Tamworth (road number - B5000)

I can confirm this this evening.

And therefor cannot be an SP50 (if that only relates to a motorway).

I would imagine you will need to get the police to tell the speedy fine people to change the code and then all should be well.

What I`m getting at, if we`re being upfront about things:

Is there any chance I can get the points rescinded & the fine refunded because the copper made a mistake with the ticket.

I don`t think there`s much/anything you can do as you have pleaded `guilty` by accepting and paying the fine.

But I wasn`t aware that I was pleading guilty to speeding on a motorway. Surely the average motorist isn`t expected to know all the offence codes.

However, you should see about getting the code changed as insurance companies may take more interest in an SP50 than an SP30.

Yeah, thought that myself.

Isn`t the Glascote Road a 30mph limit??

I have always wondered if those speed Cameras down there worked or not lol, Thanks for confirming it.

Yes & no. It`s Glascote Road all the way down to the Arches from the top of the hill out of Polesworth (I think it`s at the boundary change between Warks & Staffs). It`s only after the last roundabout (junction with Marlborough Way/Sheepcote Lane) that it becomes 30mph.

I didn`t get got by the cameras, so I`ve no idea if they work or not. I got done by a plod with a radar gun waiting in the bus stop at the top of the hill by the Sacred Heart church.

Anyway, what takes you down there kazanddan?

sneaky little gits!....surely he should of made himself visible, but saying that, I was going down the Sutton Bypass one sunday afternoon, and a sly one was hiding underneath one of the bridges behind a concrete post......daft thing was he`d parked his van a few yards back which stuck out like a sore thumb, so why he hid is anyones guess.
